Hi,

I'm in the process of recording a song for my Mother. It's for her birthday.

I decided the track needed some elaborate gypsy violin throughout and, not being a violinist myself, found one on the web who'll record the whole thing improvised for me over several takes and post it all to me on CD so I can edit together the bits I like the best.

What I'm wondering though is: what is the copyright position with the stuff he records for me?

Does he own his bit? I hope not, I'm paying him £100! (thats about $140).

What happens if, when I release my CD, I want to put this song on it? Does he have to get royalties? Does he have to be credited?

Thanks for your help.

You need to draw up a 'work for hire' contract and have him sign it. In it specify that you are the copyright owner and he's gets not credit for writing the song, only a one time fee for his efforts. I'm sure you can find a contract to download somewhere on the net, try searching through google.
